Catalan Law Meeting in Tossa

Since 1982


The twenty-first edition of the Catalan Law Symposium in Tossa is taking place 23 and 24 September 2021 and will be dedicated to the subject of "Purchase-sale, leases and new methods for temporary use of assets".

This year marks the 40th anniversary of the Catalan Law Symposium in Tossa, so the opening session will be chaired by His Honour José Antonio Xiol Ríos, who will discuss jurisdiction in civil matters and, in particular, constitutional limits to the bases of contractual obligations.

The main subject in the first block of papers will be the challenges which the requisite transposition of the recent EU Directives 770 and 771/2019 into national law represents for the new regulations of the Sixth Book of the Catalan Civil Code, as well as the problems that the partial unconstitutionality of the registration system for resolutive conditions in land entails in property sales. The second block will focus on leasing goods in general, looking at European principles in the subject and at the already very advanced pre-legislative work in the Catalan Codification Commission. The Friday block will focus on a subject of considerably topicality and social interest, urban-property leases, with a talk on permanent housing rent, and another discussing the Executive Decree on social rent and other rules in this highly complex area. Finally, the last block of papers will concentrate on urban-property renting for other uses.

This edition’s new developments will include three round tables on the topical issues of movable- and immovable-property renting, with social players and expert in very different fields, besides those strictly related to law.

Background and content

Since 1982, and almost uninterruptedly during these forty years, the Catalan Law Conferences in Tossa de Mar have been the forum where academic research work has met with the practical perspective of law professionals to intervene in the development of the new Catalan Civil Law, with a past, present and future vision. In the twenty editions of the conferences, all the major issues have been addressed, from basic questions of responsibility in civil matters to succession law and the Europeanisation of private law, passing through property law and the updating of family law. The last few Conferences focused on analysing European Regulations regarding inheritance, family and succession, from the perspectives of both private international law and civil law. The Conference Materials of all the editions have been later published, and are indispensable reading for contemporary Catalan law experts.
