1. What is "Law & Economics"? Positive and normative analysis. The concept of efficiency of rules and policies and its relationship with morals. A brief history of "Law & Economics" (from Adam Smith and J. Bentham to Calabresi - Posner - Coase)

2. Private Law. Contracts from a "Law and Economics" viewpoint. The social role of exchange. The enforcement of private legal agreements between economics and morality. Efficient breach and default remedies.

3. Private Law (Part II): Tort Law. The social functions of tort law. Negligence and strict liability. The "optimal" level of deterrence.

4. Dispute Resolution: balancing public and private means of resolving conflicts (ADR).

5. Criminal Law. The "economics" of crime. What acts should be made criminal offenses? The decision to commit a crime and the definition of "optimal punishment". Different kinds of criminal response.

6. The economics of politics: public choice theory. Elections, representation and democratic legitimacy.

Activitats d'avaluació:

The continued evaluation plan consists of: a) a minimum of 80% attendance in scheduled classroom sessions, b) a written open book examen in which the student has to apply the basic concepts included in the syllabus; and c) participation in class (no more than 15% of the final mark). This open book exam will be held the last day of the course (21st December 2021).

For those students that do not pass the continued evaluation, there will be a final exam consisting in a 20 multiple choice questions.

Criteris específics de la nota «No Presentat»:
Any student who does not show up to take the final test as scheduled according to the official calendar of exams will be given a mark of “incomplete”. Students who have successfully completed the activities of continued evaluation plan are not required to take the final exam.

Avaluació única:
This special assessment will consist of a single test-type exam, in addition to open questions, on the entire content of the subject matter.

Requisits mínims per aprovar:
To pass the exam, a minimum qualification of 5.0 is required.

At the scheduled time, in person, or also virtually, by previous appointment with the Professor.

Preferably in person or, if necessary, by email (or virtually, via other means).

This subject is included in the ENGLISH PROGRAMME of the Faculty of Law of the University of Girona. All learning activities and materials are in English. Therefore, a minimum level of English is necessary to be able to follow the lessons. Previous knowledge of economic theory is NOT required to take this course.
The specific parts of the materials of the course will be indicated during the classes.
