Reusing data

La reutilització de dades es preveu a la llei: (LOPDGDD) Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales , for the processing of health data, in the additional provision 17.2c, and the transitory sixth provision of the law (the latter in relation to the data collected before the LOPDGDD came into force). Based on the General Data Protection Regulation (GDPR): Regulation (EU) 2016/679 of the Parliament and of the Board, of 27 April 2016, according to article 9.2j that allows the use of data for compatible purposes, including research, in the terms of article 89 of the GDPR, which at the same time refers to the legislation of each country. This is a case of secondary use of data for the purposes of research compatible with the GDPR.

To use this supposition as a base, the duty of informing the owner of the data must be fulfilled, according to article 13 of the GDPR, and a favourable report from the corresponding Committee of Ethics must also be available.
